The procedure for authorising stays on medical grounds aims to allow foreign nationals who are genuinely and seriously ill to come to Belgium for medical treatment if a refusal would have unacceptable humanitarian consequences.

For example, if the disease/condition is such that it poses a real threat to the patient’s life or physical integrity, or a real risk of inhuman or degrading treatment because there is no adequate treatment in the patient’s country of origin or in the country of residency.

The application must be submitted to the Office des Etrangers (NB: aliens office).

The application must contain all the information necessary to grant the authorisation: 

  • A copy of a valid piece of ID;
  • The medical certificates must meet the criteria set out in the royal decree dated 24/01/2011;
  • All relevant medical documents informing the Office des Etrangers about the patient’s health.
